The curator may make an interim distribution on certain claims, if the supervisory judge grants permission for this upon the petition of the curator.
The supervisory judge may grant permission if:
it is sufficiently probable for which amounts the relevant claims will be verified in full or at least;
an interim distribution is desirable in order to ensure that the period after the declaration of bankruptcy over which interest accrues is shortened; and
the interim distributions are not made at the expense of other creditors.
De curator kan een tussentijdse uitkering doen op bepaalde vorderingen, indien de rechter-commissaris daarvoor op verzoek van de curator toestemming geeft.
De rechter-commissaris kan toestemming verlenen indien:
voldoende waarschijnlijk is voor welke bedragen de desbetreffende vorderingen geheel of ten minste zullen worden geverifieerd;
een tussentijdse uitkering wenselijk is om te bewerkstelligen dat de periode na de faillietverklaring waarover de interesten lopen, wordt bekort; en
de tussentijdse uitkeringen niet ten koste gaan van andere schuldeisers.
