Dissolution of the homologated agreement may be claimed by any creditor towards whom the debtor fails to comply with the contents thereof.
The burden of proof that the composition has been complied with rests on the debtor.
The court may, also of its own motion, grant the debtor a postponement of at most one month in order to still fulfil his obligations.
Ontbinding van het gehomologeerde akkoord kan door elke schuldeiser gevorderd worden, jegens wie de schuldenaar in gebreke blijft aan de inhoud daarvan te voldoen.
Op de schuldenaar rust het bewijs, dat aan het akkoord is voldaan.
De rechter kan, ook ambtshalve, de schuldenaar uitstel van ten hoogste één maand verlenen, om alsnog aan zijn verplichtingen te voldoen.
