If Article 389 has been applied, the lease agreement shall, in deviation from Article 325, be extended by six years each time.
The court may, in addition to the grounds referred to therein, also grant the claim referred to in Article 370 on the ground that the lessor intends to implement such management with regard to the preservation or development of the natural and landscape values present on the land that further leasing is not consistent therewith. In respect of all grounds for granting the claim, the court shall take into account equity in connection with the specific nature of the lease agreement.
Indien toepassing is gegeven aan artikel 389 wordt de pachtovereenkomst in afwijking van artikel 325 telkens met zes jaren verlengd.
De rechter kan de in artikel 370 bedoelde vordering, behalve op de daar bedoelde gronden, ook toewijzen op de grond dat de verpachter met betrekking tot de instandhouding of ontwikkeling van de op het land aanwezige waarden van natuur en landschap een zodanig beheer wil voeren dat verdere verpachting hiermee niet in overeenstemming is. Bij alle toewijzingsgronden houdt hij rekening met de billijkheid in verband met de bijzondere aard van de pachtovereenkomst.
