Article 7:349

The lessee is authorised, until the evacuation, to undo changes and additions made by him, provided that the leased property is thereby brought into the condition which, at the end of the lease, can reasonably be considered to be in accordance with the original condition.
The lessee is not obliged to undo permitted alterations and additions, without prejudice to the power of the court to impose an obligation on him, pursuant to Article 348, paragraph 4, to ensure this is done prior to the vacation of the leased property.
De pachter is tot de ontruiming bevoegd door hem aangebrachte veranderingen en toevoegingen ongedaan te maken, mits daarbij het gepachte in de toestand wordt gebracht, die bij het einde van de pacht redelijkerwijs in overeenstemming met de oorspronkelijke kan worden geacht.
De pachter is niet verplicht tot het ongedaan maken van geoorloofde veranderingen en toevoegingen, onverminderd de bevoegdheid van de rechter om hem op de voet van artikel 348 lid 4 de verplichting op te leggen hiervoor vóór de ontruiming van het gepachte zorg te dragen.
