If a defect which the lessor is not obliged to remedy pursuant to Article 339 renders the enjoyment that the lessee could expect entirely impossible, both the lessee and the lessor are authorised to dissolve the agreement in the manner set forth in Article 267 of Book 6.
An obligation of one of the parties to pay compensation for damages in respect of a defect shall also include the damages caused by the termination of the agreement pursuant to paragraph 1.
Indien een gebrek dat de verpachter ingevolge artikel 339 niet verplicht is te verhelpen, het genot dat de pachter mocht verwachten geheel onmogelijk maakt, is zowel de pachter als de verpachter bevoegd de overeenkomst op de voet van artikel 267 van Boek 6 te ontbinden.
Een verplichting van een der partijen tot schadevergoeding ter zake van een gebrek omvat mede de door het eindigen van de overeenkomst ingevolge lid 1 veroorzaakte schade.
