The principal may only be required to make payments that, at least approximately, correspond to the progress of the construction or to the value of the goods transferred to him, except that it may be stipulated that, as security for the performance of his obligations, he shall deposit an amount not exceeding 10% of the contract price with a notary or provide substitute security for this amount. Any excess paid shall be considered as an undue payment (onverschuldigd betaald).
De opdrachtgever kan slechts worden verplicht tot het doen van betalingen die, althans bij benadering, overeenstemmen met de voortgang van de bouw of met de waarde van de aan hem overgedragen goederen, behoudens dat kan worden bedongen dat hij ter verzekering van de nakoming van zijn verplichtingen een bedrag dat niet hoger is dan 10% van de aanneemsom, in depot stort bij een notaris dan wel voor dit bedrag vervangende zekerheid stelt. Het teveel betaalde geldt als onverschuldigd betaald.
