Before the client is bound by an agreement as referred to in Article 765 or by an offer to that effect, the contractor shall inform the client in writing and unequivocally whether and, if so, in what manner the performance of his obligations regarding the execution of the work and his liability for defects attributable to him is or will be covered by insurance or another financial security. This information shall be provided in a clear and comprehensible manner for the client and shall in any event relate to the scope of the insurance or the financial security, the level of coverage, the duration, and the sum for which the insurance has been concluded or the financial security has been provided.
The information referred to in paragraph 1 shall form an integral part of the agreement.
Voordat de opdrachtgever gebonden is aan een overeenkomst als bedoeld in artikel 765 dan wel aan een daartoe strekkend aanbod, informeert de aannemer de opdrachtgever schriftelijk en ondubbelzinnig of en, zo ja, op welke wijze de nakoming van zijn verplichtingen tot uitvoering van het werk en zijn aansprakelijkheid voor gebreken die aan hem zijn toe te rekenen door een verzekering dan wel een andere financiële zekerheid is of zal worden gedekt. Deze informatie wordt op een voor de opdrachtgever duidelijke en begrijpelijke wijze verstrekt en ziet in ieder geval op de omvang van de verzekering of de financiële zekerheid, de dekkingsgraad, de looptijd en de som waarvoor de verzekering is afgesloten dan wel de financiële zekerheid is verstrekt.
De in het eerste lid bedoelde informatie vormt een integraal onderdeel van de overeenkomst.
