With due observance of the rules referred to in Article 97, paragraph 1, the Council shall annually, prior to the relevant budget year, establish a proposal for a budget for the Council and the courts jointly, including the regulations to be attached to the budget to be allocated, as well as a multi-annual estimate for at least four years following the budget year.
Before the Council adopts the budget proposal and the multi-annual estimate, the Council shall consult with the courts.
The Council shall submit the budget proposal and the multi-annual estimate to Our Minister by a date to be determined by Our Minister.
Insofar as the budget proposal and the multi-annual budget relate to disciplinary complaints that are dealt with by the Amsterdam Court of Appeal pursuant to Article 45, paragraph 1, of the Judicial Officers Act (Gerechtsdeurwaarderswet), the Royal Professional Organisation of Judicial Officers shall be heard. Insofar as the budget proposal and the multi-annual budget relate to disciplinary complaints that are dealt with by the Amsterdam Court of Appeal pursuant to Article 107, paragraph 1, of the Notaries Act (Wet op het notarisambt), the Royal Notarial Professional Organisation shall be heard.
Rules may be established by or pursuant to an Order in Council regarding the preparation and structure of the budget proposal and the multi-annual estimate, including the explanatory notes and annexes pertaining thereto.
Met inachtneming van de regels, bedoeld in artikel 97, eerste lid, stelt de Raad jaarlijks, voorafgaand aan het desbetreffende begrotingsjaar, een voorstel vast voor een begroting van de Raad en de gerechten gezamenlijk, met inbegrip van de aan het toe te kennen budget te verbinden voorschriften, alsmede een meerjarenraming voor ten minste vier op het begrotingsjaar volgende jaren.
Alvorens de Raad het begrotingsvoorstel en de meerjarenraming vaststelt, voert de Raad overleg met de gerechten.
De Raad zendt het begrotingsvoorstel en de meerjarenraming voor een door Onze Minister te bepalen tijdstip aan Onze Minister.
Voor zover het begrotingsvoorstel en de meerjarenbegroting zien op tuchtklachten die op grond van artikel 45, eerste lid, van de Gerechtsdeurwaarderswet worden behandeld door het gerechtshof Amsterdam wordt de Koninklijke Beroepsorganisatie van Gerechtsdeurwaarders gehoord. Voor zover het begrotingsvoorstel en de meerjarenbegroting zien op tuchtklachten die op grond van artikel 107, eerste lid, van de Wet op het notarisambt worden behandeld door het gerechtshof Amsterdam wordt de Koninklijke Notariële Beroepsorganisatie gehoord.
Bij of krachtens algemene maatregel van bestuur kunnen regels worden gesteld met betrekking tot de voorbereiding en de inrichting van het begrotingsvoorstel en de meerjarenraming, met inbegrip van de daarbij behorende toelichting en bijlagen.
