The Supreme Court shall take cognizance, in the first and final instance, of official crimes and official misdemeanours committed by members of the States-General, ministers, and state secretaries.

For the purposes of this provision, official crimes and official misdemeanours are understood to mean criminal offences committed under one of the aggravating circumstances described in Article 44 of the Criminal Code.

In the proceedings referred to in the first and second paragraphs, the Supreme Court is also competent to take cognizance of the claim for compensation of costs and damages on behalf of the injured party.

In the proceedings referred to in the first and second paragraphs, the Supreme Court shall adjudicate with a panel of ten justices. In the event of a tie in the voting, a decision shall be rendered in favour of the defendant.

De Hoge Raad neemt in eerste instantie, tevens in hoogste ressort, kennis van de ambtsmisdrijven en ambtsovertredingen begaan door de leden van de Staten-Generaal, de ministers en de staatssecretarissen.

Onder ambtsmisdrijven en ambtsovertredingen worden hier begrepen strafbare feiten begaan onder een der verzwarende omstandigheden omschreven in artikel 44 van het Wetboek van Strafrecht.

In de gedingen, bedoeld in het eerste en tweede lid, is de Hoge Raad tevens bevoegd kennis te nemen van de vordering tot vergoeding van kosten en schaden ten behoeve van de benadeelde partij.

In de gedingen, bedoeld in het eerste en tweede lid, oordeelt de Hoge Raad met een aantal van tien raadsheren. Bij het staken der stemmen wordt een uitspraak ten voordele van de verdachte gedaan.
