The Supreme Court (Hoge Raad) takes cognizance, in the first and final instance, of jurisdictional disputes between:
the courts, unless Article 61 applies;
Courts of appeal
a court of appeal and a district court;
a court belonging to the judiciary and a court not belonging to the judiciary;
administrative courts, unless another administrative court has jurisdiction in the matter.
If a jurisdictional dispute has arisen between the Supreme Court and another court referred to in the first paragraph, the Supreme Court shall, for the purpose of deciding thereon, be composed as much as possible of justices who have not yet taken cognizance of the case.
De Hoge Raad neemt in eerste aanleg, tevens in hoogste ressort, kennis van jurisdictiegeschillen tussen:
rechtbanken, tenzij artikel 61 van toepassing is;
gerechtshoven;
een gerechtshof en een rechtbank;
een tot de rechterlijke macht behorend gerecht en een niet tot de rechterlijke macht behorend gerecht;
bestuursrechters, tenzij een andere bestuursrechter daartoe bevoegd is.
Indien het jurisdictiegeschil is gerezen tussen de Hoge Raad en een ander in het eerste lid genoemd gerecht, wordt de Hoge Raad ter beslissing daarvan zoveel mogelijk samengesteld uit raadsheren die van de zaak nog geen kennis genomen hebben.
