Article 48b

The provisions of Articles 46c, 46ca, 46d, 46e, 46f, 46i, with the exception of the first paragraph under c, 46j, 46l, first and third paragraphs, 46m, 46o and 46p, of the Legal Status of Judicial Officers Act (Wet rechtspositie rechterlijk ambtenaren) shall apply mutatis mutandis to the expert members of the land chambers (pachtkamers) and their deputies, on the understanding that for the application mutatis mutandis of Article 46j and 46o, second paragraph, respectively, functional authority shall be understood to mean: the board and the president of the court, respectively. Furthermore, Articles 44, first, fourth up to and including eighth and tenth paragraphs, and 44a, first up to and including eighth and tenth paragraphs, of this Act shall apply mutatis mutandis to them, on the understanding that the board of the court shall be designated as their functional authority, they shall be equated with deputy judges in the same court for the application mutatis mutandis of Article 44, first and seventh paragraphs, and the president of the court shall exercise the power referred to in Article 44, sixth paragraph, with respect to them.
They shall be entitled to reimbursement of their travel and accommodation expenses and further compensation in accordance with rules to be established by Order in Council.
Regulations for the implementation of this Article and of Article 48a shall be provided by Order in Council.
Het in de artikelen 46c, 46ca, 46d, 46e, 46f, 46i, met uitzondering van het eerste lid onder c, 46j, 46l, eerste en derde lid, 46m, 46o en 46p, van de Wet rechtspositie rechterlijk ambtenaren bepaalde is van overeenkomstige toepassing ten aanzien van de deskundige leden van de pachtkamers en hun plaatsvervangers, met dien verstande dat voor de overeenkomstige toepassing van artikel 46j onderscheidenlijk 46o, tweede lid, onder functionele autoriteit wordt verstaan: bestuur onderscheidenlijk president van het gerecht. Tevens zijn de artikelen 44, eerste, vierde tot en met achtste en tiende lid, en 44a, eerste tot en met achtste en tiende lid, van deze wet op hen van overeenkomstige toepassing, met dien verstande dat het bestuur van het gerecht wordt aangemerkt als hun functionele autoriteit, zij voor de overeenkomstige toepassing van artikel 44, eerste en zevende lid, worden gelijkgesteld met rechters-plaatsvervangers in hetzelfde gerecht, en de president van het gerecht ten aanzien van hen de bevoegdheid, bedoeld in artikel 44, zesde lid, uitoefent.
Zij genieten vergoeding voor hun reis- en verblijfkosten en verdere vergoeding volgens bij algemene maatregel van bestuur vast te stellen regels.
Bij algemene maatregel van bestuur worden voorschriften gegeven ter uitvoering van dit artikel en van artikel 48a.
