The board shall annually submit a report to the Council by a time to be determined by the Council.
The report consists of the annual accounts with the accompanying budget, the amendments made therein, the annual report, and other financial data.
The annual accounts shall provide an account and justification of the financial management of the court for the preceding financial year.
The annual accounts require the approval of the Council. Approval may only be withheld on the grounds of non-compliance with the law. Articles 10:28 up to and including 10:31 of the General Administrative Law Act (Algemene wet bestuursrecht) apply mutatis mutandis.
The annual report shall state the manner in which the activities for which the budget has been granted at the expense of the national budget have been carried out. In this regard, it shall be indicated how these activities relate to the plan as established for the relevant year in accordance with Article 31 and to the financing rules applicable in the relevant year, as referred to in Article 97, paragraph 1.
By way of derogation from Article 17, paragraph 2, the board shall adopt the annual report by a majority of votes, which must include the vote of the president.
The Council may issue general instructions regarding the structure of the report.
Het bestuur dient jaarlijks voor een door de Raad te bepalen tijdstip bij de Raad een verslag in.
Het verslag bestaat uit de jaarrekening met bijbehorende begroting, de daarin aangebrachte wijzigingen, het jaarverslag en overige financiële gegevens.
In de jaarrekening wordt rekening en verantwoording afgelegd van het financiële beheer van het gerecht over het voorafgaande begrotingsjaar.
De jaarrekening behoeft de instemming van de Raad. De instemming kan slechts worden onthouden wegens strijd met het recht. De artikelen 10:28 tot en met 10:31 van de Algemene wet bestuursrecht zijn van overeenkomstige toepassing.
In het jaarverslag wordt vermeld op welke wijze de werkzaamheden ten behoeve waarvan het budget ten laste van de rijksbegroting is verleend, zijn uitgevoerd. Daarbij wordt aangegeven op welke wijze deze werkzaamheden zich verhouden tot het plan zoals dit overeenkomstig artikel 31 voor het desbetreffende jaar is vastgesteld en tot de in het desbetreffende jaar geldende financieringsregels, bedoeld in artikel 97, eerste lid.
In afwijking van artikel 17, tweede lid, stelt het bestuur het jaarverslag vast met meerderheid van stemmen, waaronder de stem van de president.
De Raad kan omtrent de inrichting van het verslag algemene aanwijzingen geven.
