If the budget has not obtained the approval of the Council, the board shall at all times require the approval of the Council to incur expenses.
A petition by the management board for consent may only be rejected by the Council on the grounds of conflict with the law or the interest of sound business operations of the court. Articles 10:28 up to and including 10:30 of the General Administrative Law Act (Algemene wet bestuursrecht) apply mutatis mutandis.
The Council shall decide on the petition within eight weeks of receipt of the petition. Consent shall be deemed to have been granted if no decision from the Council has been received within this period.
The Council may attach conditions to the consent.
The Council may determine for which items and up to what amount the board does not require approval.
Indien de begroting niet de instemming van de Raad heeft verkregen, behoeft het bestuur tot het doen van uitgaven steeds de instemming van de Raad.
Een verzoek van het bestuur om instemming kan door de Raad slechts worden afgewezen wegens strijd met het recht of het belang van een goede bedrijfsvoering van het gerecht. De artikelen 10:28 tot en met 10:30 van de Algemene wet bestuursrecht zijn van overeenkomstige toepassing.
De Raad beslist op het verzoek binnen acht weken na ontvangst van het verzoek. De instemming wordt geacht te zijn verleend indien binnen deze termijn geen beslissing van de Raad is ontvangen.
De Raad kan aan de instemming voorschriften verbinden.
De Raad kan bepalen voor welke posten en tot welk bedrag het bestuur geen instemming behoeft.
