By way of derogation from Article 4.6, paragraph 1, of the Government Accounts Act 2016 (Comptabiliteitswet 2016), the management board shall perform private-law legal acts on behalf of the State insofar as these arise from the part of the budget of the Ministry of Security and Justice managed by it, unless it is provided by or pursuant to the law that a minister other than Our Minister shall perform the legal act.
Article 10:12 of the General Administrative Law Act and Article 4.12, paragraphs 1 and 4, of the Government Accounts Act 2016 (Comptabiliteitswet 2016) shall apply mutatis mutandis.
In afwijking van artikel 4.6, eerste lid, van de Comptabiliteitswet 2016 verricht het bestuur namens de staat privaatrechtelijke rechtshandelingen voor zover die voortvloeien uit het door hem beheerde deel van de begroting van het Ministerie van Veiligheid en Justitie, tenzij bij of krachtens de wet is bepaald dat een andere minister dan Onze Minister de rechtshandeling verricht.
Artikel 10:12 van de Algemene wet bestuursrecht en artikel 4.12, eerste en vierde lid, van de Comptabiliteitswet 2016 zijn van overeenkomstige toepassing.
