The Board shall establish the budget of the court as part of the annual plan in accordance with the budget estimated by the Council, as referred to in Article 30.
The budget of the court requires the approval of the Council. Articles 10:28 up to and including 10:30 of the General Administrative Law Act apply mutatis mutandis.
Consent may only be withheld on the grounds of conflict with the law or the interest of the proper administration of the court.
The Council shall decide within eight weeks after receipt of the budget of the court. Consent shall be deemed to have been granted if no decision from the Council has been received within this period.
In cases of urgent necessity, the board may make an expenditure before the relevant budget has obtained the approval of the Council. The Council shall be informed thereof immediately.
Het bestuur stelt de begroting van het gerecht als onderdeel van het jaarplan vast in overeenstemming met het door de Raad geraamde budget, bedoeld in artikel 30.
De begroting van het gerecht behoeft de instemming van de Raad. De artikelen 10:28 tot en met 10:30 van de Algemene wet bestuursrecht zijn van overeenkomstige toepassing.
De instemming kan slechts worden onthouden wegens strijd met het recht of het belang van een goede bedrijfsvoering van het gerecht.
De Raad beslist binnen acht weken na ontvangst van de begroting van het gerecht. De instemming wordt geacht te zijn verleend indien binnen deze termijn geen beslissing van de Raad is ontvangen.
In gevallen van dringende spoed kan het bestuur een uitgave doen voordat de desbetreffende begroting de instemming van de Raad heeft verkregen. De Raad wordt daarvan terstond in kennis gesteld.
