Insofar as the wages do not exceed the amount referred to in Article 17, paragraph 1, of the Financing of Social Insurance Act (Wet financiering sociale verzekeringen), in relation to a pay period of one day, the employee who performs work other than on the basis of an appointment under public law shall, during the leave referred to in Article 5:1, retain the right to 70% of the wages, but at least to the statutory minimum wage applicable to him.
The first paragraph shall apply mutatis mutandis to the employee who performs work on the basis of an appointment under public law.
Voorzover het loon niet meer bedraagt dan het bedrag, bedoeld in artikel 17, eerste lid, van de Wet financiering sociale verzekeringen, met betrekking tot een loontijdvak van een dag, behoudt de werknemer, die anders dan op grond van een publiekrechtelijke aanstelling arbeid verricht, gedurende het verlof, bedoeld in artikel 5:1, recht op 70% van het loon, maar ten minste op het voor hem geldende wettelijke minimumloon.
Het eerste lid is van overeenkomstige toepassing op de werknemer, die arbeid verricht op grond van een publiekrechtelijke aanstelling.
