The minor has, subject to the restrictions to be imposed in accordance with the second and third paragraphs, the right to inspect the data recorded in his file.
The director may withhold certain information from the juvenile who submits a petition for access to his file or parts thereof, if this is necessary for the maintenance of order or safety within the institution, in the interest of the mental or physical development of the juvenile, for the protection of the personal privacy of persons other than the juvenile insofar as they are not involved in the implementation, or when the execution of the perspective plan so requires.
The director may limit the right of access to evaluation reports to a summary thereof, if the implementation of the perspective plan (perspectiefplan) so requires.
In the event of the application of the second or third paragraph, the director may:
orally inform the minor of the data to which he requests access, or
to grant the person authorised by the minor access to the data to which access is withheld from the minor.
With regard to the perspective plan and the evaluation report, the right of access also includes the right to receive a copy.
Pursuant to Article 464 of Book 7 of the Civil Code, Article 456 of this Book shall not apply mutatis mutandis to the files referred to in this Chapter.
De jeugdige heeft, behoudens de overeenkomstig het tweede en derde lid te stellen beperkingen, recht op inzage van de in zijn dossier vastgelegde gegevens.
De directeur kan de jeugdige die een verzoek doet tot inzage van zijn dossier of delen daarvan, bepaalde gegevens onthouden, indien dit noodzakelijk is voor de handhaving van de orde of de veiligheid in de inrichting, in het belang van de geestelijke of lichamelijke ontwikkeling van de jeugdige, ter bescherming van de persoonlijke levenssfeer van anderen dan de jeugdige voor zover die niet bij de tenuitvoerlegging betrokken zijn, of wanneer de uitvoering van het perspectiefplan dit vereist.
De directeur kan het recht op inzage van evaluatieverslagen beperken tot een daarvan gemaakte samenvatting, indien de uitvoering van het perspectiefplan dit vereist.
De directeur kan, in geval van toepassing van het tweede of derde lid:
de jeugdige mondeling kennis geven van de gegevens waarvan hij inzage verlangt, of
een door de jeugdige gemachtigde persoon inzage geven in de gegevens waarvan de inzage aan de jeugdige wordt onthouden.
Voor wat betreft het perspectiefplan en het evaluatieverslag omvat het recht op inzage tevens het recht op het ontvangen van een afschrift.
Met toepassing van artikel 464 van Boek 7 van het Burgerlijk Wetboek is artikel 456 van dit boek niet van overeenkomstige toepassing op de dossiers, bedoeld in dit hoofdstuk.
