Appeal regarding placement, transfer, and decisions on petitions

The appeal shall be heard by a committee of three members or extraordinary members appointed by the Council, which shall be assisted by a secretary. With regard to the appeal referred to in Article 72, paragraph 1, Article 69, paragraphs 3 and 4, shall apply mutatis mutandis.

The notice of appeal shall be filed no later than the seventh day following the day on which the person concerned has become aware of the decision against which he lodges an appeal. A notice of appeal filed after the expiry of this period shall nevertheless be admissible if it cannot reasonably be judged that the detainee has been in default.

If the person concerned is detained, the filing of the petition (application) may be effected through the intervention of the director of the institution or department where he resides. The director shall ensure that the petition (application) is provided with a date without delay. The date of the petition (application) shall be deemed to be the date of filing.

Articles 60, paragraph 3, 61, paragraph 4, 63, 64, 65, 66, 67, paragraph 2, first and third up to and including fifth sentence, paragraph 4 and paragraph 7, with the exception of the first sentence, 68, paragraphs 1, 2, 3, 4, 6 and 7, shall apply mutatis mutandis, on the understanding that the committee referred to in the first paragraph may determine that:

a.

the parties concerned shall be given the opportunity to explain the appeal exclusively in writing;

b.

the oral comments may be made before a member of the committee referred to in the first paragraph;

c.

In the event that information is obtained orally from another person, the parties involved shall be given the opportunity exclusively to submit in writing the questions they wish to see put to that person.

In the proceedings regarding an appeal against an order as referred to in Article 40d, parties who are obliged to provide information or to produce documents may, by way of derogation from the provisions of Article 65, paragraph 3, refuse to provide information or to produce documents if there are compelling reasons for doing so, or inform the committee that only it shall be permitted to take cognizance of the information or the documents, respectively.

The committee shall decide whether the refusal or, as the case may be, the restriction of access to information referred to in the fifth paragraph is justified. If the committee has decided that the refusal is justified, the obligation shall lapse.

If the committee has decided that the restriction on the inspection of documents is justified, it may only render a decision based in part on that information or those documents, respectively, with the consent of the other party.

8.

If consent is refused, the matter shall be referred to another committee which shall decide on the appeal.

The court shall render its decision as soon as possible.

Het beroepschrift wordt behandeld door een door de Raad benoemde commissie van drie leden of buitengewone leden, die wordt bijgestaan door een secretaris. Ten aanzien van het beroepschrift, bedoeld in artikel 72, eerste lid, is artikel 69, derde en vierde lid, van overeenkomstige toepassing.

Het beroepschrift wordt ingediend uiterlijk op de zevende dag na die waarop de betrokkene kennis heeft gekregen van de beslissing waartegen hij beroep instelt. Een na afloop van deze termijn ingediend beroepschrift is niettemin ontvankelijk, indien redelijkerwijs niet kan worden geoordeeld dat de gedetineerde in verzuim is geweest.

Indien de betrokkene gedetineerd is, kan de indiening van het beroepschrift geschieden door tussenkomst van de directeur van de inrichting of afdeling waar hij verblijft. De directeur draagt zorg dat het beroepschrift onverwijld van een dagtekening wordt voorzien. Als dag waarop het beroepschrift is ingediend geldt die van de dagtekening.

De artikelen 60, derde lid, 61, vierde lid, 63, 64, 65, 66, 67, tweede lid, eerste en derde tot en met vijfde volzin, vierde en zevende lid, met uitzondering van de eerste volzin, 68, eerste, tweede, derde, vierde, zesde en zevende lid, zijn van overeenkomstige toepassing, met dien verstande dat de commissie, bedoeld in het eerste lid, kan bepalen dat:

a.

de betrokkenen uitsluitend in de gelegenheid worden gesteld het beroepschrift schriftelijk toe te lichten;

b.

de mondelinge opmerkingen ten overstaan van een lid van de commissie, bedoeld in het eerste lid, kunnen worden gemaakt;

c.

ingeval bij een ander persoon mondeling inlichtingen worden ingewonnen, de betrokkenen uitsluitend in de gelegenheid worden gesteld schriftelijk de vragen op te geven die zij aan die persoon gesteld wensen te zien.

Bij de behandeling van het beroepschrift op een bevel als bedoeld in artikel 40d, kunnen, in afwijking van het bepaalde in artikel 65, derde lid, partijen die verplicht zijn inlichtingen te geven dan wel stukken over te leggen, indien daarvoor gewichtige redenen zijn, het geven van inlichtingen dan wel het overleggen van stukken weigeren of de commissie mededelen dat uitsluitend zij kennis zal mogen nemen van de inlichtingen onderscheidenlijk de stukken.

De commissie beslist of de in het vijfde lid bedoelde weigering onderscheidenlijk de beperking van de kennisneming gerechtvaardigd is. Indien de commissie heeft beslist dat de weigering gerechtvaardigd is, vervalt de verplichting.

Indien de commissie heeft beslist dat de beperking van de kennisneming gerechtvaardigd is, kan zij slechts met toestemming van de andere partij mede op de grondslag van die inlichtingen onderscheidenlijk die stukken uitspraak doen.

8.

Indien de toestemming wordt geweigerd, wordt de zaak verwezen naar een andere commissie die op het beroep beslist.

9.

De Raad doet zo snel mogelijk uitspraak.
