Article 72

The person concerned has the right to lodge a reasoned appeal with the committee referred to in Article 73, paragraph 1, against the decision of Our Minister regarding the notice of objection or petition, insofar as this concerns a full or partial declaration of being unfounded, or a rejection as referred to in Articles 17, 18 and 40a, paragraphs 5 and 6. The person concerned also has the right to lodge an appeal in the event that the lodging of a notice of objection was omitted on the ground as stated in Article 17, paragraph 5.
The detainee has the right to submit a reasoned appeal to the committee referred to in Article 73, paragraph 1, against a decision concerning leave that pertains to him, insofar as no complaint procedure is available against this decision pursuant to Article 60, paragraphs 1 and 2.
An appeal against the decision as referred to in the first paragraph of Article 46e may be lodged directly with the Council.
De betrokkene heeft het recht tegen de beslissing van Onze Minister op het bezwaar- of verzoekschrift voor zover dit betreft een gehele of gedeeltelijke ongegrondverklaring, onderscheidenlijk afwijzing als bedoeld in de artikelen 17, 18 en 40a, vijfde en zesde lid een met redenen omkleed beroepschrift in te dienen bij de commissie, bedoeld in artikel 73, eerste lid. De betrokkene heeft ook het recht een beroepschrift in te dienen in het geval dat het indienen van een bezwaarschrift op de grond als vermeld in artikel 17, vijfde lid, achterwege is gebleven.
De gedetineerde heeft het recht tegen een hem betreffende beslissing aangaande verlof, voor zover hiertegen geen beklag ingevolge artikel 60, eerste en tweede lid, openstaat, een met redenen omkleed beroepschrift in te dienen bij de commissie, bedoeld in artikel 73, eerste lid.
Tegen de beslissing als bedoeld in het eerste lid van artikel 46e kan rechtstreeks beroep worden ingesteld bij de Raad.
