The director may determine that a detainee, during solitary confinement, shall have their freedom of movement restricted by the attachment of mechanical means to their body for a period not exceeding twenty-four hours, if such restriction is necessary to avert a serious danger emanating from the detainee to their own health or the safety of persons other than the detainee. The director shall immediately notify the physician or their substitute and the supervisory committee of the attachment.
If immediate enforcement of the measure referred to in the first paragraph is required, an official or employee may decide to do so and enforce it for a period of no more than four hours. The director, the physician or their substitute, and the supervisory committee shall be notified of this without delay.
The director may extend the decision to attach mechanical means to the body of the detainee each time by a maximum of twenty-four hours. The decision to extend shall be taken after consultation with the physician attached to the institution or their substitute.
Our Minister shall establish further rules regarding the attachment of mechanical devices to the body.
De directeur kan bepalen dat een gedetineerde tijdens de afzondering door bevestiging van mechanische middelen aan zijn lichaam voor een periode van ten hoogste vierentwintig uren in zijn bewegingsvrijheid wordt beperkt, indien die beperking noodzakelijk is ter afwending van een van de gedetineerde uitgaand ernstig gevaar voor diens gezondheid of de veiligheid van anderen dan de gedetineerde. De directeur stelt de arts of diens vervanger en de commissie van toezicht van de bevestiging onverwijld in kennis.
Indien onverwijlde tenuitvoerlegging van de maatregel, bedoeld in het eerste lid, geboden is, kan een ambtenaar of medewerker hiertoe beslissen en deze voor een periode van ten hoogste vier uren ten uitvoer leggen. De directeur, de arts of diens vervanger en de commissie van toezicht worden hiervan onverwijld in kennis gesteld.
De directeur kan de beslissing tot bevestiging van mechanische middelen aan het lichaam van de gedetineerde telkens met ten hoogste vierentwintig uren verlengen. De beslissing tot verlenging wordt genomen na overleg met de aan de inrichting verbonden arts of diens vervanger.
