In deviation from Article 13, paragraph 1, subparagraph g, the municipal executive (college) may grant special assistance:
in the form of suretyship, if the application of the interested party for the granting of a debt restructuring credit has been rejected due to his limited possibilities for repayment and the suretyship is necessary to enable the credit transaction to proceed nevertheless by a:
municipal credit bank (gemeentelijke kredietbank) as referred to in the Financial Supervision Act (Wet op het financieel toezicht);
a financial enterprise which, pursuant to the Financial Supervision Act (Wet op het financieel toezicht), is permitted to conduct the business of a bank in the Netherlands, if the municipality is not affiliated with a municipal credit bank or does not maintain a relationship therewith;
if very urgent reasons exist therefor and the possibility mentioned under (a) offers no solution.
In afwijking van artikel 13, eerste lid, onderdeel g, kan het college bijzondere bijstand verlenen:
in de vorm van borgtocht, indien het verzoek van de belanghebbende tot verlening van een saneringskrediet is afgewezen vanwege diens beperkte mogelijkheden tot terugbetaling en de borgtocht noodzakelijk is om de krediettransactie alsnog doorgang te doen vinden door een:
gemeentelijke kredietbank als bedoeld in de Wet op het financieel toezicht;
een financiële onderneming die ingevolge de Wet op het financieel toezicht in Nederland het bedrijf van bank mag uitoefenen, indien de gemeente niet is aangesloten bij een gemeentelijke kredietbank dan wel daarmee geen relatie onderhoudt;
indien daartoe zeer dringende redenen bestaan en de in onderdeel a genoemde mogelijkheid geen uitkomst biedt.
