The debtor is in default in the event of any failure in the performance of the agreement and is obliged to compensate the damage which the voting creditors or shareholders suffer as a result thereof, unless the failure cannot be attributed to him. Article 75 and Section 10 of Title 1 of Book 6 of the Civil Code apply mutatis mutandis.
In the agreement, the dissolution of the agreement may be excluded. If the agreement does not contain a provision to this effect, Article 165 applies mutatis mutandis.
De schuldenaar is in verzuim bij iedere tekortkoming in de nakoming van het akkoord en is verplicht de schade die de stemgerechtigde schuldeisers of aandeelhouders daardoor lijden te vergoeden, tenzij de tekortkoming hem niet kan worden toegerekend. Artikel 75 en afdeling 10 van Titel 1 van Boek 6 van het Burgerlijk Wetboek zijn van overeenkomstige toepassing.
In het akkoord kan de ontbinding van het akkoord worden uitgesloten. Als het akkoord hiertoe geen bepaling omvat, is artikel 165 van overeenkomstige toepassing.
