The judgment of homologation constitutes, for the benefit of the creditors entitled to vote with claims not disputed by the debtor, an enforceable title against the debtor and against the persons who have acceded to the agreement as guarantors, to the extent that the creditors acquire a claim for the payment of a sum of money on the basis of the agreement.
Het vonnis van homologatie levert ten behoeve van de stemgerechtigde schuldeisers met niet door de schuldenaar betwiste vorderingen een voor tenuitvoerlegging vatbare titel op tegen de schuldenaar en tegen de tot het akkoord als borgen toegetreden personen, voor zover de schuldeisers op basis van het akkoord een vordering krijgen tot betaling van een geldsom.
