The draft agreement lapses:
if the application of the debt restructuring scheme is not pronounced;
if, before the judgment of homologation of the composition has become final, a judicial decision terminating the application of the debt restructuring scheme becomes final;
if the application of the debt restructuring scheme ends pursuant to the provisions of Article 312, paragraph 2.
Het ontwerp van een akkoord vervalt:
indien de toepassing van de schuldsaneringsregeling niet wordt uitgesproken;
indien, voordat het vonnis van homologatie van het akkoord in kracht van gewijsde is gegaan, een rechterlijke uitspraak tot beëindiging van de toepassing van de schuldsaneringsregeling in kracht van gewijsde gaat;
indien de toepassing van de schuldsaneringsregeling eindigt op grond van het bepaalde in artikel 312, tweede lid.
