Without prejudice to the provisions of Article 15, paragraph 3, the salary of the trustee in each bankruptcy is determined by the court.
In the event of an agreement, the salary is determined by the judgment of homologation.
The court determines the salary of the bankruptcy trustee (curator) on the basis of principles that reflect the importance of an efficient administration of the bankruptcy. If the court considers deviating from a proposal of the bankruptcy trustee for the determination of his salary, or if the supervisory judge (rechter-commissaris) does not agree with such a proposal, the court shall not take a decision as referred to in the first and second paragraphs until after it has given the bankruptcy trustee the opportunity to present his views, in a manner to be further determined by it and within a time limit to be determined by it.
By or pursuant to an Order in Council, further rules may be laid down regarding the financing of the activities of the curator referred to in Article 68, paragraph 2.
Onverminderd het bepaalde in artikel 15, derde lid, wordt het salaris van de curator in elk faillissement door de rechtbank vastgesteld.
In geval van akkoord wordt het salaris bij het vonnis van homologatie bepaald.
De rechtbank stelt het salaris van de curator vast aan de hand van uitgangspunten waarin het belang van een efficiënte behandeling van het faillissement tot uitdrukking komt. Overweegt de rechtbank om af te wijken van een voorstel van de curator tot vaststelling van zijn salaris of stemt de rechter-commissaris niet met een dergelijk voorstel in, dan neemt de rechtbank geen beslissing als bedoeld in het eerste en tweede lid dan nadat zij de curator op een door haar nader te bepalen wijze en binnen een door haar te bepalen termijn in de gelegenheid heeft gesteld een zienswijze te geven.
Bij of krachtens algemene maatregel van bestuur kunnen nadere regels worden gesteld over de financiering van de werkzaamheden van de curator, bedoeld in artikel 68, tweede lid.
