Article 63

The bankruptcy of the person who is married in any community of property or has entered into a registered partnership in any community of property is treated as the bankruptcy of that community. It comprises, subject to the exceptions of Article 21, all property that falls within the community, and serves for the benefit of all creditors who have recourse against the property of the community. Property that the bankrupt has outside the community serves only for the recovery of debts that could be recovered against it if there were no community whatsoever.
In the event of the bankruptcy of a debtor who is married in community of property or who has entered into a registered partnership in community of property, the provisions of this Act concerning acts performed by the debtor are applicable to the acts by which the community is lawfully bound, regardless of which of the spouses or registered partners, respectively, performed them.
Het faillissement van de persoon die in enige gemeenschap van goederen gehuwd is of in enige gemeenschap van goederen een geregistreerd partnerschap is aangegaan, wordt als faillissement van die gemeenschap behandeld. Het omvat, behoudens de uitzonderingen van artikel 21, alle goederen, die in de gemeenschap vallen, en strekt ten behoeve van alle schuldeisers, die op de goederen der gemeenschap verhaal hebben. Goederen die de gefailleerde buiten de gemeenschap heeft, strekken slechts tot verhaal van schulden die daarop verhaald zouden kunnen worden, indien er generlei gemeenschap was.
Bij het faillissement van een schuldenaar die in gemeenschap van goederen gehuwd is of die in gemeenschap van goederen een geregistreerd partnerschap is aangegaan, zijn de bepalingen van deze wet omtrent handelingen door de schuldenaar verricht, toepasselijk op de handelingen waardoor de gemeenschap wettig verbonden is, onverschillig wie van de echtgenoten onderscheidenlijk van de geregistreerde partners deze verrichtte.
