The bankruptcy trustee may set a reasonable time limit for the pledgees and mortgagees to proceed to exercise their rights in accordance with the preceding article. If the pledgee or mortgagee has not sold the collateral within this time limit, the bankruptcy trustee may claim the property and sell it pursuant to Articles 101 or 176, without prejudice to the right of the pledgees and mortgagees to the proceeds. The supervisory judge is competent to extend the time limit one or more times upon the petition (application) of the pledgee or mortgagee.

The curator may redeem an asset encumbered with a right of pledge or mortgage up to the time of the sale against satisfaction of that for which the right of pledge or mortgage serves as security, as well as of the costs of execution already incurred.

De curator kan de pand- en hypotheekhouders een redelijke termijn stellen om tot uitoefening van hun rechten overeenkomstig het vorige artikel over te gaan. Heeft de pand- of hypotheekhouder het onderpand niet binnen deze termijn verkocht, dan kan de curator de goederen opeisen en met toepassing van de artikelen 101 of 176 verkopen, onverminderd het recht van de pand- en hypotheekhouders op de opbrengst. De rechter-commissaris is bevoegd de termijn op verzoek van de pand- of hypotheekhouder een of meer malen te verlengen.

De curator kan een met pand of hypotheek bezwaard goed tot op het tijdstip van de verkoop lossen tegen voldoening van hetgeen waarvoor het pand- of hypotheekrecht tot zekerheid strekt, alsmede van de reeds gemaakte kosten van executie.
