Pledgees and mortgagees may exercise their rights as if there were no bankruptcy.
In the distribution, the persons entitled to a limited right whose right was established prior to the declaration of bankruptcy, but has been extinguished by the execution by a pledgee or mortgagee, may also appear in their own right for their right to compensation for damages referred to in Article 282 of Book 3 of the Civil Code.
In the distribution of the proceeds, the trustee in bankruptcy also exercises, for the benefit of the estate, the rights that the law confers upon attaching creditors on the property. He is obliged to also represent the interests of the preferred creditors who rank above the aforementioned pledgees and mortgagees and holders of limited rights.
If a ranking procedure (rangregeling) is necessary, a petition for it is made to the preliminary relief judge (voorzieningenrechter) of the court of which the supervisory judge (rechter-commissaris) in the bankruptcy is a member. The distribution takes place before this supervisory judge in the manner prescribed in the Code of Civil Procedure.
Pand- en hypotheekhouders kunnen hun recht uitoefenen, alsof er geen faillissement was.
Bij de verdeling kunnen uit eigen hoofde mede de beperkt gerechtigden opkomen, wier recht vóór de faillietverklaring was gevestigd, maar door de executie door een pand- of hypotheekhouder is vervallen, voor hun recht op schadevergoeding, bedoeld in artikel 282 van Boek 3 van het Burgerlijk Wetboek.
Bij de verdeling van de opbrengst oefent de curator ten behoeve van de boedel mede de rechten uit, die de wet aan beslagleggers op het goed toekent. Hij is gehouden mede de belangen te behartigen van de bevoorrechte schuldeisers die in rang boven de voormelde pand- en hypotheekhouders en beperkt gerechtigden gaan.
Zo een rangregeling nodig is, wordt deze verzocht aan de voorzieningenrechter van de rechtbank waarvan de rechter-commissaris in het faillissement lid is. De verdeling geschiedt ten overstaan van deze rechter-commissaris op de wijze voorgeschreven in het Wetboek van Burgerlijke Rechtsvordering.
