If an own declaration or a petition (application) for a declaration of bankruptcy and a petition (application) for the appointment of a restructuring expert as referred to in Article 371 are pending simultaneously, the latter shall be dealt with first.
The consideration of the own declaration or the petition (application) for a declaration of bankruptcy shall in any event be suspended until the court has decided on the petition (application) for the appointment of the restructuring expert. If the court grants the petition (application), it shall simultaneously declare a cooling-off period in accordance with Article 376, and the suspension shall remain in force during that period.
Als een eigen aangifte of een verzoek tot faillietverklaring en een verzoek tot aanwijzing van een herstructureringsdeskundige als bedoeld in artikel 371 gelijktijdig aanhangig zijn, komt eerst het laatste in behandeling.
De behandeling van de eigen aangifte of het verzoek tot faillietverklaring wordt in ieder geval geschorst totdat de rechtbank heeft beslist op het verzoek tot aanwijzing van de herstructureringsdeskundige. Wijst de rechtbank het verzoek toe, dan kondigt zij daarbij tevens overeenkomstig artikel 376 een afkoelingsperiode af en blijft de schorsing tijdens die periode van kracht.
