If the bankrupt is the hire-purchaser, both the trustee in bankruptcy and the seller may declare the hire purchase or the hire purchase of a ship dissolved.
This dissolution has the same consequences as dissolution of the agreement on account of the non-performance by the buyer of his obligations.
The seller may claim as an unsecured creditor for the amount due to him.
Indien de gefailleerde huurkoper is, kan zowel de curator als de verkoper de huurkoop dan wel scheepshuurkoop ontbonden verklaren.
Deze ontbinding heeft dezelfde gevolgen als ontbinding der overeenkomst wegens het niet nakomen door de koper van zijn verplichtingen.
De verkoper kan voor het hem verschuldigde bedrag als concurrent schuldeiser opkomen.
