The declaration of bankruptcy is made by the court of the domicile of the debtor.
If the debtor has gone outside the Realm in Europe, the court of his last domicile has jurisdiction.
With respect to partners in a general partnership, the court within whose district the office of the partnership is established also has jurisdiction.
If the debtor has no domicile within the Realm in Europe, but practices a profession or conducts a business there, the court within whose district he has an office is competent.
If, in the case of the third or fourth paragraph, the declaration of bankruptcy is pronounced by more than one competent court on different days, then only the first judgment pronounced has legal effect. If the judgment of different courts takes place on the same day, then only the judgment of the court which is mentioned first in the Act of 10 August 1951, Stb. 347, has legal effect.
De faillietverklaring geschiedt door de rechtbank van de woonplaats des schuldenaars.
Indien de schuldenaar zich buiten het Rijk in Europa heeft begeven, is de rechtbank zijner laatste woonplaats bevoegd.
Ten aanzien van vennoten onder ene firma is de rechtbank, binnen welker gebied het kantoor der vennootschap is gevestigd, mede bevoegd.
Indien de schuldenaar binnen het Rijk in Europa geen woonplaats heeft, doch aldaar een beroep of bedrijf uitoefent, is de rechtbank, binnen welker gebied hij een kantoor heeft, bevoegd.
Wordt in het geval van het derde of vierde lid door meer dan één daartoe bevoegde rechtbank op verschillende dagen de faillietverklaring uitgesproken, dan heeft alleen de eerst gedane uitspraak rechtsgevolgen. Heeft de uitspraak van verschillende rechtbanken op dezelfde dag plaats, dan heeft alleen de uitspraak van de rechtbank, die in de wet van 10 augustus 1951, Stb. 347 het eerst genoemd wordt, rechtsgevolgen.
