Excluded from the voting on the composition are the creditors to whose claim priority is attached, including those whose priority is disputed, unless they, prior to the commencement of the voting, waive their priority for the benefit of the estate.
This waiver renders them unsecured creditors, also in the event that the composition should not be adopted.
Van de stemming over het akkoord zijn uitgesloten de schuldeisers aan wier vordering voorrang verbonden is daaronder begrepen diegenen, wier voorrang betwist wordt, tenzij zij, vóór de aanvang der stemming, van hun voorrang ten behoeve van de boedel afstand mochten doen.
Deze afstand maakt hen tot concurrente schuldeisers, ook voor het geval het akkoord niet mocht worden aangenomen.
