No derogation from the provisions of this section may be made to the detriment of the consumer.
The consumer may not be deprived of the protection granted to him under this Section as a result of the way in which agreements are drafted, in particular by including a credit agreement within the meaning of this Directive in a credit agreement the nature or purpose of which makes it possible to avoid the application of those measures.
Van het bepaalde bij deze afdeling kan niet ten nadele van de consument worden afgeweken.
De consument kan de hem krachtens deze afdeling toegekende bescherming niet worden ontzegd als gevolg van de wijze waarop overeenkomsten zijn opgesteld, met name doordat een kredietovereenkomst in de zin van deze Richtlijn is opgenomen in een kredietovereenkomst waarvan de aard of het doel het mogelijk maakt de toepassing van die maatregelen te ontwijken.
