An asset that a spouse acquires other than for no consideration shall remain outside the community of property if the consideration for the acquisition of this asset is charged to his own separate estate for more than half. To the extent that the consideration is charged to the community of property, the spouse is liable to provide compensation to the community. The amount of the compensation shall be determined in accordance with Article 87, paragraphs 2 and 3.

If an asset becomes part of the community and a spouse has contributed to the consideration from his own assets upon acquisition, this spouse shall be entitled to a claim for reimbursement, the amount of which shall be determined in accordance with Article 87, paragraphs 2 and 3.

Een goed dat een echtgenoot anders dan om niet verkrijgt, blijft buiten de gemeenschap indien de tegenprestatie bij de verkrijging van dit goed voor meer dan de helft ten laste komt van zijn eigen vermogen. Voor zover de tegenprestatie ten laste van de gemeenschap komt, is de echtgenoot gehouden tot een vergoeding aan de gemeenschap. Het beloop van de vergoeding wordt bepaald overeenkomstig artikel 87, tweede en derde lid.

Indien een goed tot de gemeenschap gaat behoren en een echtgenoot bij de verkrijging uit zijn eigen vermogen aan de tegenprestatie heeft bijgedragen, komt deze echtgenoot een vergoedingsvordering toe, waarvan het beloop overeenkomstig artikel 87, tweede en derde lid, wordt bepaald.

Man and woman jointly acquired a residence prior to their marriage. Man and woman are mutually entitled to reimbursement for excess contribution (meerinbreng) in connection with the payment of the purchase price by the man and in connection with the repayment by the woman of a loan entered into to finance a renovation. Subsequently, they marry in 2018 in a community of property, as a result of which the residence falls into the matrimonial community of property. Claims for reimbursement in connection with the payment of the purchase price and the repayment of the loan do not fall into the matrimonial community of property. Do the debts corresponding to those claims fall into the matrimonial community of property?
