Any person who is involved in the performance of the task of an administrative authority and thereby obtains access to data the confidential nature of which he knows or should reasonably suspect, and for whom a duty of confidentiality in respect of such data does not already apply by virtue of office, profession or statutory provision, is obliged to maintain the confidentiality of such data, except insofar as any statutory provision obliges him to disclose them or the necessity of disclosure arises from his task.
Paragraph 1 is also applicable to institutions and persons belonging thereto or working therefor that are involved by an administrative body in the performance of its task, and to institutions and persons belonging thereto or working therefor that perform a task assigned by or pursuant to the law.
Een ieder die is betrokken bij de uitvoering van de taak van een bestuursorgaan en daarbij de beschikking krijgt over gegevens waarvan hij het vertrouwelijke karakter kent of redelijkerwijs moet vermoeden, en voor wie niet reeds uit hoofde van ambt, beroep of wettelijk voorschrift ter zake van die gegevens een geheimhoudingsplicht geldt, is verplicht tot geheimhouding van die gegevens, behoudens voor zover enig wettelijk voorschrift hem tot mededeling verplicht of uit zijn taak de noodzaak tot mededeling voortvloeit.
Het eerste lid is mede van toepassing op instellingen en daartoe behorende of daarvoor werkzame personen die door een bestuursorgaan worden betrokken bij de uitvoering van zijn taak, en op instellingen en daartoe behorende of daarvoor werkzame personen die een bij of krachtens de wet toegekende taak uitoefenen.
