The person who wishes to conclude a health insurance contract shall state his address in the petition for that purpose, and if he is not the person to be insured, the address of the person to be insured.
The health insurer shall not conclude the insurance as long as the provided address of the person or persons referred to in the first paragraph does not appear in the Personal Records Database (basisregistratie personen) or deviates from the address at which this person or these persons is or are registered as a resident in that administration.
By way of derogation from the second paragraph, the person to be insured shall be registered:
if the person wishing to conclude the health insurance has submitted a statement from the employer or a salary slip, from which it appears that the person to be insured, with mention of the commencement date of the employment, is subject to wage tax in respect of work performed in employment in the Netherlands or on the continental shelf as referred to in Article 1.1.1 of the Long-term Care Act (Wet langdurige zorg), provided that such statement or salary slip is not older than one month;
if the person who wishes to conclude the health insurance has submitted a statement from the Social Insurance Bank (Sociale verzekeringsbank) from which it appears that the person to be insured is insured pursuant to the Long-term Care Act (Wet langdurige zorg); or
if the person or persons referred to in the second paragraph cannot reasonably be blamed for the deviation.
Rules may be laid down by ministerial regulation with regard to the third paragraph.
Degene die een zorgverzekering wenst te sluiten, vermeldt bij het verzoek daartoe zijn adres, en indien hij niet de te verzekeren persoon is, het adres van de te verzekeren persoon.
De zorgverzekeraar sluit de verzekering niet zolang het verstrekte adres van de persoon of personen, bedoeld in het eerste lid, niet in de basisregistratie personen voorkomt of afwijkt van het adres waaronder deze persoon of personen in die administratie als ingezetene staat of staan ingeschreven.
In afwijking van het tweede lid wordt de te verzekeren persoon ingeschreven:
indien degene die de zorgverzekering wenst te sluiten een verklaring van de werkgever of een salarisafschrift heeft overgelegd, waaruit blijkt dat de te verzekeren persoon, onder vermelding van de ingangsdatum van de dienstbetrekking, ter zake van in Nederland of op het continentaal plat als bedoeld in artikel 1.1.1 van de Wet langdurige zorg, in dienstbetrekking verrichte arbeid aan de loonbelasting is onderworpen, mits die verklaring of het salarisafschrift niet ouder zijn dan één maand;
indien degene die de zorgverzekering wenst te sluiten een verklaring van de Sociale verzekeringsbank heeft overgelegd waaruit blijkt dat de te verzekeren persoon verzekerd is ingevolge de Wet langdurige zorg; of
indien de persoon of de personen, bedoeld in het tweede lid, van de afwijking redelijkerwijs geen verwijt kan worden gemaakt.
Bij ministeriële regeling kunnen regels worden gesteld met betrekking tot het derde lid.
