in forceThe obligation to conclude a health insurance contract · § The duty to accept
Any person who wishes to conclude a health insurance contract shall, upon the petition for that purpose, state the citizen service number (burgerservicenummer) of the person to be insured, if that person possesses such a number.
The health insurer shall establish the identity of the person to be insured, insofar as this is reasonably necessary for the implementation of the health insurance and of this Act.
The determination referred to in the second paragraph shall be made on the basis of documents as referred to in Article 1 of the Compulsory Identification Act, which the policyholder or the person to be insured shall submit for inspection to him upon request.
The health insurer shall record the nature and number of the documents referred to in the third paragraph in its records.
The health insurer shall require from the foreign national, as referred to in the Aliens Act 2000, for whom a request is made to conclude a health insurance contract with said insurer, a copy of the document or the written statement, as referred to in Article 9, paragraph 1, of that Act, which is designated as a document as referred to in Article 4:3, paragraph 2, of the General Administrative Law Act.
Degene die een zorgverzekering wenst te sluiten, vermeldt bij het verzoek daartoe het burgerservicenummer van de te verzekeren persoon, indien deze persoon daarover beschikt.
De zorgverzekeraar stelt, voor zover dat redelijkerwijs nodig is voor de uitvoering van de zorgverzekering en van deze wet, de identiteit van de te verzekeren persoon vast.
De in het tweede lid bedoelde vaststelling geschiedt aan de hand van documenten als bedoeld in artikel 1 van de Wet op de identificatieplicht, die de verzekeringnemer of de te verzekeren persoon hem desgevraagd ter inzage geeft.
De zorgverzekeraar neemt aard en nummer van de in het derde lid bedoelde documenten in zijn administratie op.
De zorgverzekeraar verlangt van de vreemdeling, bedoeld in de Vreemdelingenwet 2000, voor wie hem wordt verzocht een zorgverzekering te sluiten, een kopie van het document of de schriftelijke verklaring, bedoeld in artikel 9, eerste lid, van die wet, dat wordt aangemerkt als een bescheid als bedoeld in artikel 4:3, tweede lid, van de Algemene wet bestuursrecht.
