A report as referred to in Article 16 which relates to another Member State shall be shared without delay by the Financial Intelligence Unit with the financial intelligence unit of that Member State, unless the provision of the report:
is contrary to a statutory provision;
a criminal investigation may be prejudiced;
may disproportionately prejudice the interests of natural persons or legal entities to whom the information relates.
Een melding als bedoeld in artikel 16 die betrekking heeft op een andere lidstaat, wordt door de Financiële inlichtingen eenheid onverwijld gedeeld met de financiële inlichtingen eenheid van die lidstaat, tenzij het verstrekken van de melding:
strijdig is met een wettelijk voorschrift;
een strafrechtelijk onderzoek kan schaden;
de belangen van natuurlijke of rechtspersonen op wie de informatie betrekking heeft onevenredig kan schaden.
