When a deed within the meaning of Article 156, paragraph 1, of the Code of Civil Procedure is presented to a civil-law notary with a request to include it in his protocol, he is obliged to take cognizance of its contents and to execute a deed of the presentation and inclusion, and to attach the document to that deed, without prejudice to the provisions of Article 95 of Book 4 of the Civil Code.

Without prejudice to the provisions of Article 21, paragraph 2, the civil-law notary may refuse his services if the petitioner cannot demonstrate that he has a reasonable interest in the inclusion of the offered document in the protocol.

Wanneer aan de notaris een akte in de zin van artikel 156, eerste lid, van het Wetboek van Burgerlijke Rechtsvordering wordt aangeboden, met verzoek deze in zijn protocol op te nemen, is hij verplicht van de inhoud daarvan kennis te nemen en van de aanbieding en opname een akte te verlijden en het stuk aan die akte te hechten, onverminderd het bepaalde in artikel 95 van Boek 4 van het Burgerlijk Wetboek.

Onverminderd het bepaalde in artikel 21, tweede lid, kan de notaris zijn dienst weigeren indien de verzoeker niet aannemelijk kan maken dat hij bij opneming van het aangeboden stuk in het protocol een redelijk belang heeft.
