in forceThe traineeship, the registration of working hours and the professional training of the candidate civil-law notary
The junior civil-law notary (kandidaat-notaris) who:
has accepted employment at a civil-law notary’s office; or
has accepted work at another branch of a civil-law notary office; or
A person who works more or fewer hours per week at a civil-law notary office shall notify the KNB thereof within one week after having commenced the performance of those activities or after their working hours have been changed.
This notification shall be signed as "seen" by the relevant civil-law notary. If the junior civil-law notary is employed by or is a member of a partnership of civil-law notaries or of civil-law notaries and junior civil-law notaries, this may be performed by one of those civil-law notaries. If it is the first time that he is employed as a junior civil-law notary, he shall at the same time submit the certificate of the examination he has passed or a recognition of professional qualifications as referred to in Article 5 of the General Act on Recognition of EU Professional Qualifications.
The notification entails:
date and place of birth of the candidate civil-law notary;
the first names, the surname and the place of establishment of the civil-law notary at whose office the junior civil-law notary (kandidaat-notaris) was most recently employed and the period during which this was the case, or the declaration that he has not previously been employed at a civil-law notary's office as a junior civil-law notary (kandidaat-notaris);
in the event of part-time employment, the number of hours per week that the candidate civil-law notary (kandidaat-notaris) is employed at the civil-law notary's office.
The KNB shall send the candidate civil-law notary a confirmation of receipt of the notification. It shall also return to the candidate civil-law notary the certificate signed by it as "seen", if this has been submitted to it.
Within one week after the junior civil-law notary has terminated his activities at the civil-law notary's office, the civil-law notary shall notify the KNB thereof in writing.
Upon request, the KNB shall issue a statement to the junior civil-law notary (kandidaat-notaris) confirming that he has completed the traineeship referred to in Article 31.
De kandidaat-notaris die:
werkzaamheden op een notariskantoor heeft aanvaard; of
werkzaamheden in een andere vestiging van een notariskantoor heeft aanvaard; of
meer of minder uren per week op een notariskantoor werkzaam is, geeft hiervan binnen een week nadat hij met de uitoefening van die werkzaamheden is begonnen of nadat zijn arbeidsduur is gewijzigd, kennis aan de KNB.
Deze kennisgeving wordt door de desbetreffende notaris voor «gezien» getekend. Indien de kandidaat-notaris werkzaam is voor of deel uitmaakt van een maatschap van notarissen of van notarissen en kandidaat-notarissen kan zulks geschieden door één van die notarissen. Indien het de eerste maal is dat hij als kandidaat-notaris werkzaam is, legt hij daarbij tevens het getuigschrift van het door hem afgelegd examen dan wel een erkenning van beroepskwalificaties over als bedoeld in artikel 5 van de Algemene wet erkenning EU-beroepskwalificaties.
De kennisgeving houdt in:
datum en plaats van geboorte van de kandidaat-notaris;
de voornamen, de naam en de plaats van vestiging van de notaris te wiens kantore de kandidaat-notaris het laatst werkzaam is geweest en gedurende welk tijdvak, of de verklaring dat hij als kandidaat-notaris nog niet eerder op een notariskantoor werkzaam was;
in geval van werkzaamheid in deeltijd, het aantal uren per week dat de kandidaat-notaris op het notariskantoor werkzaam is.
De KNB zendt de kandidaat-notaris een bewijs van ontvangst van de kennisgeving. Zij zendt tevens het door haar voor «gezien» getekende getuigschrift, indien dit aan haar is overgelegd, aan de kandidaat-notaris terug.
Binnen een week nadat de kandidaat-notaris zijn werkzaamheden op het notariskantoor heeft beëindigd, geeft de notaris hiervan schriftelijk kennis aan de KNB.
Op verzoek geeft de KNB aan de kandidaat-notaris een verklaring af ter bevestiging dat hij de in artikel 31 bedoelde stage heeft doorlopen.
