A judicial decision rendered in the Member State of origin may be recognised and enforced in the Netherlands if:
the convicted person is located in the issuing Member State or in the Netherlands; and
the public prosecution service has consented to the transmission of the judicial decision, unless such consent is not required; and
the judicial decision does not cover any obligations other than those which, pursuant to Article 3:2, may be enforced in the Netherlands.
Een in de uitvaardigende lidstaat gedane rechterlijke uitspraak kan worden erkend en ten uitvoer gelegd in Nederland indien:
de veroordeelde zich in de uitvaardigende lidstaat of in Nederland bevindt; en
het openbaar ministerie heeft ingestemd met de toezending van de rechterlijke uitspraak, tenzij deze instemming niet vereist is; en
de rechterlijke uitspraak geen andere verplichtingen bestrijkt dan die op grond van artikel 3:2 in Nederland ten uitvoer kunnen worden gelegd.
