Our Minister shall provide the convicted person with the opportunity to express their opinion regarding the intention to transmit a judicial decision to the executing Member State. Unless the opinion of the convicted person gives cause to refrain from the intention, Our Minister shall notify the convicted person of his intention in writing.

The first paragraph shall not apply if the convicted person is not in the Netherlands or has requested the transmission of the judicial decision themselves.

The convicted person may, within fourteen days of receipt of the notification, file a notice of objection against the intention of Our Minister with the special chamber of the Arnhem-Leeuwarden Court of Appeal, as referred to in Article 67 of the Judiciary (Organisation) Act.

As soon as possible after receipt of a timely filed notice of objection, the special chamber of the court of appeal shall examine whether Our Minister, upon weighing the interests involved, can reasonably arrive at the intended decision.

The convicted person shall be heard during the proceedings, or at least summoned. In the event that the convicted person does not have legal counsel, the presiding judge shall instruct the board of the Legal Aid Council to appoint legal counsel.

Articles 21 up to and including 25 of the Code of Criminal Procedure shall apply mutatis mutandis.

The special chamber of the court of appeal shall notify Our Minister and the convicted person of its decision in writing. If the special chamber of the court of appeal considers the objection well-founded, Our Minister shall refrain from transmitting the judicial decision to the executing Member State.

No legal remedy is available against the decision of the special chamber of the court of appeal, other than an appeal in cassation in the interest of the law as referred to in Article 456 of the Code of Criminal Procedure.

Onze Minister stelt de veroordeelde in de gelegenheid zijn mening te geven over het voornemen om een rechterlijk uitspraak aan de uitvoerende lidstaat te zenden. Tenzij de mening van de veroordeelde aanleiding geeft om van het voornemen af te zien, geeft Onze Minister van zijn voornemen schriftelijk kennis aan de veroordeelde.

Het eerste lid blijft buiten toepassing, indien de veroordeelde zich niet in Nederland bevindt of zelf om de toezending van de rechterlijke uitspraak heeft verzocht.

De veroordeelde kan binnen veertien dagen na ontvangst van de kennisgeving tegen het voornemen van Onze Minister een bezwaarschrift indienen bij de bijzondere kamer van het gerechtshof Arnhem-Leeuwarden, bedoeld in artikel 67 van de Wet op de rechterlijke organisatie.

Zo spoedig mogelijk na ontvangst van een tijdig ingediend bezwaarschrift onderzoekt de bijzondere kamer van het gerechtshof of Onze Minister bij afweging van de betrokken belangen in redelijkheid tot de voorgenomen beslissing kan komen.

De veroordeelde wordt bij het onderzoek gehoord, althans opgeroepen. In geval de veroordeelde geen raadsman heeft, geeft de voorzitter aan het bestuur van de raad voor rechtsbijstand last tot aanwijzing van een raadsman.

De artikelen 21 tot en met 25 van het Wetboek van Strafvordering zijn van overeenkomstige toepassing.

Van zijn beslissing stelt de bijzondere kamer van het gerechtshof Onze Minister en de veroordeelde schriftelijk in kennis. Acht de bijzondere kamer van het gerechtshof het bezwaarschrift gegrond, dan ziet Onze Minister af van de toezending van de rechterlijke uitspraak aan de uitvoerende lidstaat.

Tegen de beslissing van de bijzondere kamer van het gerechtshof staat geen rechtsmiddel open, anders dan beroep in cassatie in het belang der wet als bedoeld in artikel 456 van het Wetboek van Strafvordering.
