Article 2:26

The transmission of the judicial decision may take place without the consent of the convicted person if:
the convicted person is a national of the executing Member State and has his or her permanent residence or habitual residence in the executing Member State;
the convicted person, after release, may be expelled to the executing Member State as a consequence of an obligation to leave the Netherlands imposed upon him pursuant to the Aliens Act 2000 (Vreemdelingenwet 2000);
the convicted person has fled or returned to the executing Member State following the criminal proceedings instituted against him in the Netherlands or after the conviction in the Netherlands.
Toezending van de rechterlijke uitspraak kan zonder de instemming van de veroordeelde plaatsvinden indien:
de veroordeelde onderdaan is van de uitvoerende lidstaat en in de uitvoerende lidstaat zijn vaste woon- of verblijfplaats heeft;
de veroordeelde na invrijheidstelling naar de uitvoerende lidstaat kan worden uitgezet als gevolg van een op grond van de Vreemdelingenwet 2000 aan hem opgelegde verplichting Nederland te verlaten;
de veroordeelde naar de uitvoerende lidstaat is gevlucht of teruggekeerd naar aanleiding van de tegen hem in Nederland ingestelde strafvervolging of na de veroordeling in Nederland.
