The drawee who pays a cheque transferable by endorsement is bound to examine the regularity of the series of endorsements, but not the signature of the endorsers.
If he, not having paid with discharging effect, is obliged to pay a second time, he has recourse against all those who have not acquired the cheque in good faith.
De betrokkene, die een door endossement overdraagbare chèque betaalt, is gehouden de regelmatigheid van de reeks van endossementen, maar niet de handteekening der endossanten te onderzoeken.
Indien hij, niet bevrijdend betaald hebbende, verplicht wordt, ten tweede male te betalen, heeft hij verhaal op allen die de cheque niet te goeder trouw hebben verkregen.
