A cheque, the payment of which is stipulated in a currency other than that of the place of payment, may be paid within the time limit for presentment in the currency of the country according to its value on the day of payment. If payment has not taken place upon presentment, the holder may, at his option, demand that the amount of the cheque be paid in the currency of the country according to the rate of exchange of either the day of presentment or the day of payment.
The value of the foreign currency is determined according to the usages of the place of payment. The drawer may, however, stipulate that the amount payable must be calculated according to a rate stipulated in the cheque.
The foregoing does not apply if the drawer has stipulated that payment must be effected in a specifically indicated currency (clause of actual payment in foreign currency).
If the amount of the cheque is indicated in a currency which has the same designation but a different value in the country of issue and in that of payment, one is presumed to have intended the currency of the place of payment.
Eene chèque, waarvan de betaling is bedongen in ander geld dan dat van de plaats van betaling, kan binnen den termijn van aanbieding worden betaald in het geld van het land volgens zijne waarde op den dag van betaling. Indien de betaling niet heeft plaats gehad bij de aanbieding, kan de houder te zijner keuze vorderen, dat de chèquesom voldaan wordt in het geld van het land volgens den koers, hetzij van den dag van aanbieding, hetzij van den dag van betaling.
De waarde van het vreemde geld wordt bepaald volgens de gebruiken van de plaats van betaling. De trekker kan echter voorschrijven, dat het te betalen bedrag moet worden berekend volgens een in de chèque voorgeschreven koers.
Het bovenstaande is niet van toepassing, indien de trekker heeft voorgeschreven, dat de betaling moet geschieden in een bepaald aangeduid geld (clausule van werkelijke betaling in vreemd geld).
Indien het bedrag van de chèque is aangegeven in geld, hetwelk dezelfde benaming maar een verschillende waarde heeft in het land van uitgifte en in dat van betaling, wordt men vermoed het geld van de plaats van betaling te hebben bedoeld.
