Our Minister may issue general directives regarding the performance of the tasks referred to in Article 91 by the Council, insofar as this is necessary with a view to the proper management of the judiciary.
Before issuing an instruction as referred to in the first paragraph, Our Minister shall provide the Council with the opportunity to make its views known in writing.
Our Minister shall notify the Council in writing of the intended instruction and the grounds thereof. Our Minister may set a time limit for the Council to make its views known. The views of the Council shall be provided in writing and shall be reasoned.
If the opinion of the Council is that the designation will be in violation of Article 109, the designation shall not be granted.
The designation shall be published in the Government Gazette (Staatscourant).
Article 8:2, points (a) and (b), of the General Administrative Law Act shall apply mutatis mutandis.
Onze Minister kan algemene aanwijzingen geven betreffende de uitvoering van de in artikel 91 genoemde taken door de Raad voorzover dit noodzakelijk is met het oog op een goede bedrijfsvoering van de rechterlijke organisatie.
Alvorens een aanwijzing te geven als bedoeld in het eerste lid, stelt Onze Minister de Raad in de gelegenheid schriftelijk zijn zienswijze kenbaar te maken.
Onze Minister deelt de Raad de voorgenomen aanwijzing en de motivering daarvan schriftelijk mede. Onze Minister kan de Raad voor het kenbaar maken van zijn zienswijze een termijn stellen. De zienswijze van de Raad wordt schriftelijk en gemotiveerd gegeven.
Indien de zienswijze van de Raad luidt dat de aanwijzing in strijd zal zijn met artikel 109, wordt de aanwijzing niet gegeven.
De aanwijzing wordt gepubliceerd in de Staatscourant.
Artikel 8:2, onderdelen a en b, van de Algemene wet bestuursrecht is van overeenkomstige toepassing.
