Article 62

The courts of appeal shall take cognizance, in the first instance and simultaneously in the final instance, of civil cases subject to appeal in which the parties have agreed, at the commencement of the proceedings, to bring the case before the court of appeal that would have jurisdiction in appeal by way of prorogation.
The first paragraph does not apply to matters that are not at the free disposal of the parties.
De gerechtshoven nemen in eerste aanleg, tevens in hoogste ressort, kennis van de voor hoger beroep vatbare burgerlijke zaken waarin partijen zijn overeengekomen deze bij de aanvang van het geding bij wege van prorogatie aanhangig te maken bij het gerechtshof dat in hoger beroep bevoegd zou zijn.
Het eerste lid is niet van toepassing op zaken die niet ter vrije bepaling van partijen staan.
