Our Minister may, after consultation with the Council, designate one or more courts of appeal whose seats or other places of session shall, for the benefit of a category or categories of cases to be determined in the designation, temporarily also be regarded as seats or other places of session of another court of appeal, if this is necessary as a result of a lack of sufficient session capacity within the jurisdiction in which that other court of appeal is located.
In the directive, Our Minister shall determine the period for which the directive is valid. The directive shall be valid for a maximum of three years and may be extended once for a duration of no more than one year.
If the designation concerns criminal cases, the designation shall not take place until Our Minister has consulted the Board of Procurators General regarding the matter.
The designation shall be published in the Government Gazette (Staatscourant).
The third and fourth paragraphs shall apply mutatis mutandis to an extension of the designation.
Onze Minister kan, gehoord de Raad, een gerechtshof of meerdere gerechtshoven aanwijzen waarvan de zittingsplaatsen onderscheidenlijk overige zittingsplaatsen ten behoeve van een in de aanwijzing te bepalen categorie of categorieën van zaken tijdelijk mede worden aangemerkt als zittingsplaatsen onderscheidenlijk overige zittingsplaatsen van een ander gerechtshof, indien dit noodzakelijk is als gevolg van gebrek aan voldoende zittingscapaciteit binnen het ressort waarin dat andere gerechtshof is gelegen.
In de aanwijzing bepaalt Onze Minister voor welke periode de aanwijzing geldt. De aanwijzing geldt ten hoogste drie jaren en kan eenmaal worden verlengd voor de duur van ten hoogste een jaar.
Indien de aanwijzing betrekking heeft op strafzaken vindt de aanwijzing niet plaats dan nadat Onze Minister daarover het College van procureurs-generaal heeft gehoord.
De aanwijzing wordt gepubliceerd in de Staatscourant.
Het derde en vierde lid zijn van overeenkomstige toepassing op een verlenging van de aanwijzing.
