With regard to the non-judicial member of the board, the powers under the Public Servants Act 2017 (Ambtenarenwet 2017) and Title 10 of Book 7 of the Civil Code shall be exercised by the board, excluding that member.
Further rules shall be laid down by or pursuant to an Order in Council regarding the exercise of legal status powers with respect to court officials by the board, or the board excluding the non-judicial member of the board, and by the Council for the Judiciary.
With regard to the judicial officer who is also a judicial member of the board, the powers conferred upon the board by and pursuant to the Legal Status of Judicial Officers Act (Wet rechtspositie rechterlijke ambtenaren), as well as those conferred upon the board pursuant to Article 16, paragraph 1, second sentence, of this Act, shall be exercised by the board excluding that member.
For court officials, the terms and conditions of employment apply that are included in the most recently concluded collective labour agreement for civil servants who are employed by the State under an employment contract.
Ten aanzien van het niet-rechterlijk lid van het bestuur worden de bevoegdheden uit de Ambtenarenwet 2017 en titel 10 van Boek 7 van het Burgerlijk Wetboek uitgeoefend door het bestuur uitgezonderd dat lid.
Bij of krachtens algemene maatregel van bestuur worden nadere regels gesteld omtrent de uitoefening van rechtspositionele bevoegdheden ten aanzien van de gerechtsambtenaren door het bestuur onderscheidenlijk het bestuur uitgezonderd het niet-rechterlijk lid van het bestuur en door de Raad voor de rechtspraak.
Ten aanzien van de rechterlijk ambtenaar, die tevens rechterlijk lid van het bestuur is, worden de bij en krachtens de Wet rechtspositie rechterlijke ambtenaren alsmede de ingevolge artikel 16, eerste lid, tweede volzin, van deze wet aan het bestuur toegekende bevoegdheden uitgeoefend door het bestuur uitgezonderd dat lid.
Voor gerechtsambtenaren gelden de arbeidsvoorwaarden die zijn opgenomen in de laatstelijk afgesloten collectieve arbeidsovereenkomst voor ambtenaren die krachtens een arbeidsovereenkomst met de Staat werkzaam zijn.
