At the request of the entrepreneur or the works council, the subdistrict court may exclude a member of the works council from all or certain activities of the works council for a period to be determined by it. The petition may be filed exclusively by the entrepreneur on the grounds that the works council member concerned is seriously obstructing the consultation between the works council and the entrepreneur, and by the works council on the grounds that the person concerned is seriously obstructing the activities of the works council.
Before filing a petition, the petitioner shall provide the person concerned with the opportunity to be heard regarding the petition. The entrepreneur and the works council shall inform each other of a petition filed in accordance with the first paragraph.
Op verzoek van de ondernemer of van de ondernemingsraad kan de kantonrechter voor een door hem te bepalen termijn een lid van de ondernemingsraad uitsluiten van alle of bepaalde werkzaamheden van de ondernemingsraad. Het verzoek kan uitsluitend worden gedaan, door de ondernemer op grond van het feit dat het betrokken ondernemingsraadlid het overleg van de ondernemingsraad met de ondernemer ernstig belemmert, en door de ondernemingsraad op grond van het feit dat de betrokkene de werkzaamheden van de ondernemingsraad ernstig belemmert.
Alvorens een verzoek in te dienen stelt de verzoeker de betrokkene in de gelegenheid over het verzoek te worden gehoord. De ondernemer en de ondernemingsraad stellen elkaar in kennis van een overeenkomstig het eerste lid ingediend verzoek.
